General Terms and Conditions (GTC) for Performances by the Ramsay Pipe Band

1. Scope
These General Terms and Conditions (GTC) apply to all contracts, agreements, and musical performances between the Ramsay Pipe Band, based in Aesch, Basel-Landschaft (hereinafter referred to as the “Band”), and the client or organizer (hereinafter referred to as the “Organizer”), unless otherwise agreed in writing.

2. Conclusion of Contract
A contract is concluded as soon as the Organizer confirms the offer from the Ramsay Pipe Band either in writing or verbally and the Band has declared its acceptance. Changes or additions must be made in writing.

3. Services of the Ramsay Pipe Band
The Ramsay Pipe Band undertakes to perform the agreed musical performance according to the offer. The type, duration, lineup, and location of the performance are determined by the respective agreement. Changes in the lineup for important reasons (e.g., illness) are reserved, providedthe character and quality of the performance are maintained.

 

4. Duties of the Organizer

The organizer is responsible for: a suitable, safe, and accessible performance venue adequate space for musicians, instruments, and any formations appropriate weather protection for outdoor performances (e.g., rain cover or shelter) obtaining and complying with all necessary official permits (including noise and safety regulations) Any additional costs incurred by the Ramsay Pipe Band due to insufficient organization may be charged to the organizer.

5. Remuneration and Payment Terms The agreed fee is in Swiss Francs (CHF), unless otherwise agreed. Payment is made: in cash on the day of the event or by invoice with a payment term of usually 30 days net. In the event of late payment, the Ramsay Pipe Band reserves the right to charge default interest in accordance with Swiss law on obligations.

6. Cancellation and Withdrawal

A cancellation of the performance by the organizer must be made in writing. The following cancellation conditions apply: up to 30 days before the performance: free of charge 29 to 7 days before the performance: 50% of the agreed fee less than 7 days before the performance: 100% of the agreed fee In cases of force majeure (e.g., natural events, illness of several musicians, official bans), both parties are released from their performance obligations. However, costs already incurred can be claimed.

7. Liability

The Ramsay Pipe Band is solely liable for damages caused by gross negligence or intent. The Ramsay Pipe Band is not liable for damages to people, property, or infrastructure that were not caused directly by the band. The organizer is responsible for the safety of the audience and the venue.

8. Audio, Image, and Video Recordings

Private photo, audio, and video recordings by visitors are generally allowed, provided there is no agreement stating otherwise. Commercial or public audio, image, or video recordings require the prior written consent of the Ramsay Pipe Band. The band is entitled to use its own recordings of the performance for promotional purposes (e.g., website, social media, flyers), provided that there are no legitimate interests of the event organizer to the contrary.

 

9. Data Protection

Personal data of the event organizer will be used exclusively for contract processing and handled in accordance with the applicable data protection regulations of Switzerland. Data will not be passed on to third parties unless there is a legal obligation to do so.

10. Applicable Law and Jurisdiction

Swiss law applies exclusively. The place of jurisdiction is Aesch BL, unless mandatory legal provisions stipulate a different jurisdiction.

​11. Final Provisions

Should individual provisions of these Terms and Conditions be wholly or partially ineffective or become ineffective, the validity of the remaining provisions shall remain unaffected. Amendments and additions must be made in writing.
